These Terms of Service (the "Terms") govern your access to and use of the website located at domoyourhome.com, the Domo mobile or web application, and any related services, features, content, or tools offered by Domo, LLC (collectively, the "Service"). The Service is operated by Domo, LLC, a Puerto Rico limited liability company ("Domo," "we," "us," or "our").
By accessing or using the Service — whether as a visitor, registered user, customer, or independent service provider — you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
If you are an independent service provider offering services through the Service, you are additionally bound by the separate Provider Agreement.
You agree to these Terms by doing any of the following:
(a) creating an account on the Service;
(b) requesting, scheduling, or accepting a Booking through any channel — including the website, the app, telephone, WhatsApp, SMS, email, in-person request, or any other communication channel offered by Domo;
(c) allowing a Provider to perform a Service at a property you control; or
(d) making a payment for a Service through Domo.
This means that if Domo creates a Booking on your behalf (for example, because you requested service via phone or WhatsApp), your confirmation of the appointment — by reply message, email click-through, payment of the invoice, or by permitting the Service to occur — constitutes your acceptance of these Terms and the Privacy Policy in effect at the time of the Booking.
Domo may revise these Terms at any time. The current version is always posted at domoyourhome.com/terms with the Effective Date and Document Version shown. If a change is material, Domo will give at least thirty (30) days' notice by email or by message to your account before the change takes effect. Your continued use of the Service after the new Effective Date constitutes acceptance of the revised Terms.
You must be at least eighteen (18) years old and have the legal capacity to enter into binding contracts under the laws of the Commonwealth of Puerto Rico (or your jurisdiction of residence) to use the Service. By using the Service you represent and warrant that you meet these requirements.
Domo operates a platform that connects Customers with independent Providers. Domo facilitates discovery, scheduling, communications, and payment between Customers and Providers, and may provide tools for ratings, feedback, and dispute coordination.
Domo is not the employer, agent, joint venturer, partner, or contractor of any Provider. Domo does not own, control, supervise, direct, or manage the actual Services performed at any property. Domo does not warrant the quality, safety, suitability, or legality of any Service.
The contract for Services is between the Customer and the Provider. Domo acts only as an intermediary that facilitates that relationship and the related payment, except where these Terms or the Provider Agreement expressly state otherwise.
Domo may, but is not required to, perform background checks, reference checks, or other vetting of Providers. Any such checks are not a guarantee of safety, performance, or fitness, and Domo expressly disclaims any warranty or representation regarding any Provider.
To access certain features of the Service you may need to create an account. You agree to provide accurate, current, and complete information at registration and to keep that information up to date. You are responsible for safeguarding your password and for any activity that occurs under your account. You must promptly notify Domo at info@domoyourhome.com of any unauthorized use or suspected security breach.
When you request a Booking, Domo will confirm the date, time, scope, address, and price through the channel you use (website, app, WhatsApp, or email). The Booking is considered confirmed once Domo or a Provider sends you a confirmation message.
The price of each Service is the amount disclosed to you at the time of Booking and may include the Provider's service fee, Platform Fees, applicable taxes (including Puerto Rico IVU where applicable), and any optional add-ons you select. Recurring Service prices may be adjusted with at least thirty (30) days' notice.
By placing a Booking, you authorize Domo and its payment processor to charge your selected payment method for all amounts owed in connection with the Booking, including the Service fee, applicable taxes, late fees, and authorized incidentals.
You agree that Domo (through its payment processor, Stripe) will store your payment method on file and may charge that payment method for any current or future Booking you authorize, and for any unpaid amounts as described in Section 6.5. You may update or remove your payment method at any time by contacting Domo, except that you may not remove a payment method while an invoice remains unpaid.
All card payments are processed by Stripe, Inc. ("Stripe"). Your payment card data is collected, stored, and processed by Stripe in accordance with Stripe's terms and privacy policy. Domo does not store full card numbers on its systems.
Invoices for Services rendered are due upon receipt unless otherwise stated. If an invoice remains unpaid for more than thirty (30) days from the invoice date:
(a) the unpaid balance will accrue interest at a rate of one and one-half percent (1.5%) per month (eighteen percent (18%) per annum), or the maximum rate permitted under Puerto Rico law, whichever is lower, calculated from the original due date until paid in full;
(b) you expressly authorize Domo to automatically charge the payment method on file for the full outstanding balance, including accrued interest, without further notice. This authorization applies to every Booking placed with Domo and continues for as long as Domo holds a payment method on your behalf;
(c) Domo may suspend further Services and refer the account to a collections agent. You are responsible for any reasonable costs of collection, including attorneys' fees.
You acknowledge that this is a clear and conspicuous authorization to charge your saved card for amounts owed for Services already rendered, and that this authorization is a condition of using the Service.
Tips are optional and go entirely to the Provider. Domo does not retain any portion of any tip.
Refunds are issued at Domo's reasonable discretion and only where appropriate (for example, where a Service was not performed or was materially deficient and could not be remedied). Any refund or service credit will be issued to your original payment method or as an account credit, at Domo's choice.
You may cancel or reschedule a Booking at no charge if you provide notice at least twenty-four (24) hours before the scheduled start time. Cancellations or reschedules made with less than 24 hours' notice will be charged a flat cancellation fee of fifty U.S. dollars ($50), automatically charged to the payment method on file. A no-show, lockout, or denial of access at the scheduled time will be charged the full Service fee.
If a Provider arrives at the property at the scheduled time and is unable to access the property because the Customer is not present, has not provided keys or access codes, or has otherwise prevented entry, the Booking will be treated as a no-show and the full Service fee will be charged.
If a Provider cancels, Domo will use commercially reasonable efforts to reassign the Booking to another available Provider or to reschedule. If reassignment is not possible, you will not be charged for the cancelled Booking.
Neither party is responsible for cancellation, delay, or non-performance caused by events outside its reasonable control, including hurricanes, tropical storms, floods, earthquakes, power or water outages, government orders, civil unrest, pandemics, or telecommunications failures.
Domo and its Providers take reasonable care while performing Services. If you believe that a Provider has caused damage to your property during a Service:
(a) you must report the claim to Domo at info@domoyourhome.com or via WhatsApp within twenty-four (24) hours of completion of the Service;
(b) your report must include the date and time of Service, a description of the damage, and photographs;
(c) Domo will coordinate review of the claim with the Provider and, where appropriate, with the Provider's insurance carrier. Domo's involvement is limited to facilitating the claim — Domo is not a party to it.
Claims reported after the 24-hour window may be denied. Domo does not insure your property and recommends that you maintain your own homeowners or renters insurance.
Some Services are scheduled on a recurring basis (weekly, biweekly, monthly, or as otherwise agreed). Recurring Bookings will continue at the agreed cadence until cancelled by you with at least seven (7) days' written notice (email or WhatsApp). Recurring Service pricing may be adjusted with at least thirty (30) days' notice.
You are responsible for providing a safe working environment and for complying with all laws applicable to the engagement of service workers at your property. In particular, if you regularly engage domestic or maintenance workers at your residential or commercial property in Puerto Rico, you are responsible for maintaining current and active workers' compensation coverage with the Corporación del Fondo del Seguro del Estado ("CFSE") as required by Puerto Rico law (often referred to as keeping your CFSE policy "al día"), and you agree to hold Domo and its Providers harmless from any claim, fine, or liability arising from your failure to maintain such coverage.
You also agree to:
The relationship between you and a Provider is established through Domo. You agree that, for so long as you use the Service and for a period of twenty-four (24) months after the last Booking with a particular Provider, you will not directly or indirectly engage, hire, retain, or pay that Provider for any home service outside of the Domo platform. This includes hiring the Provider directly, hiring an employee or family member of the Provider, or arranging payment outside of Domo for Services that would otherwise be booked through the Service.
This restriction protects the investment Domo makes in vetting, scheduling, insuring, training, and supporting Providers, and protects Providers from being approached outside the agreed economic structure.
If you violate this Section 11, you agree that Domo's damages would be difficult to calculate and that you will pay Domo, as liquidated damages and not as a penalty, an amount equal to twelve (12) months of the average monthly fees you previously paid Domo for the same Service, plus any reasonable costs of enforcement.
This Section survives termination of these Terms.
You agree not to use the Service to:
Domo may suspend or terminate accounts, refuse service, and report violations to law enforcement.
By providing your email address or phone number, you expressly consent to receive transactional communications from Domo and Providers — including Booking confirmations, reminders, scheduling messages, payment notices, and service follow-ups — by email, SMS, WhatsApp, or voice call, including via automated systems. Message and data rates may apply.
You may opt out of marketing communications at any time:
Opting out of marketing communications does not stop transactional communications related to your Bookings, payments, or account.
Domo uses automated systems and artificial intelligence tools (including third-party AI services) to assist with scheduling, customer support, message drafting, billing automation, and operational analytics. These tools may process information you provide — such as your name, address, Booking details, and message content — in order to deliver the Service. Domo does not use your personal information to train third-party AI models. See the Privacy Policy for details.
You may submit reviews, ratings, photos, comments, and other content to the Service ("User Content"). You retain ownership of your User Content, but you grant Domo a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, distribute, display, and create derivative works of your User Content in connection with the Service and Domo's business, including for marketing.
You represent that you own or have all rights necessary to grant this license, and that your User Content does not infringe any third-party right or violate any law.
Domo may, but is not required to, review, edit, or remove User Content at its discretion.
The Service, including its software, content, design, logos, and trademarks, is owned by Domo or its licensors and is protected by intellectual property laws. The marks "Domo," "DomoYourHome," and related logos are trademarks of Domo, LLC. You may not copy, modify, distribute, or create derivative works of the Service except as expressly permitted in these Terms.
The Service relies on third-party platforms and processors, including Stripe (payments), BookingKoala (scheduling), Supabase (data storage), Meta/WhatsApp (messaging), and others described in the Privacy Policy. Your use of those third-party services is also governed by their respective terms and privacy policies. Domo is not responsible for third-party services it does not control.
THE SERVICE AND ALL SERVICES PERFORMED BY PROVIDERS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. DOMO MAKES NO WARRANTY REGARDING THE QUALITY, SAFETY, OR RELIABILITY OF ANY PROVIDER OR SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DOMO, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
DOMO'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID TO DOMO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM AND (b) ONE HUNDRED U.S. DOLLARS ($100).
You agree to defend, indemnify, and hold harmless Domo, its members, officers, employees, and Providers from and against any claim, loss, damage, liability, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or third-party right; (c) damage to property or persons caused by you or your guests; or (d) your failure to maintain CFSE coverage where required.
You may close your account at any time by contacting info@domoyourhome.com. Domo may suspend or terminate your account, without notice, for any breach of these Terms or for any reason in Domo's reasonable discretion. Sections that by their nature should survive termination (including 6.5, 8, 11, 15, 18, 19, 20, 22, and 23) will survive.
These Terms and any dispute arising under or related to them are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-laws principles.
You and Domo agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service, including its breach, termination, enforcement, interpretation, or validity, will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in San Juan, Puerto Rico, in English or Spanish at the parties' election. Judgment on the award may be entered in any court of competent jurisdiction.
You and Domo each waive any right to participate in a class, collective, or representative action. All disputes must be brought in the parties' individual capacity. If this waiver is held to be unenforceable, the rest of Section 22 will be null and void for that dispute.
Either party may bring an individual action in small-claims court, or seek injunctive or equitable relief from a court of competent jurisdiction to protect intellectual property rights or enforce Section 11 (Non-Circumvention).
If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
Domo's failure to enforce any provision is not a waiver of its right to enforce that provision later.
You may not assign these Terms without Domo's written consent. Domo may assign these Terms in connection with a merger, acquisition, or sale of assets.
These Terms, together with the Privacy Policy and (for Providers) the Provider Agreement, are the entire agreement between you and Domo regarding the Service and supersede all prior agreements.
You agree that these Terms may be accepted electronically and that your electronic acceptance — including by clicking a button, replying YES to a message, paying an invoice, or otherwise confirming a Booking — has the same legal effect as a handwritten signature.
